Formative Intelligence Inc. is the data controller responsible for your personal information. At YouArt, your privacy is of utmost importance to us, and this privacy policy outlines how we collect, use, and protect your personal information when you use our AI creative services.

Information Collection and Use

We collect the following types of data to provide you with a better experience while using Youart:

  1. Account Information

    • What We Collect: This includes your name, email address, profile information, and any other information you provide when creating an account.
    • Purpose: To manage your account, provide customer support, and personalize your AI creative experience.

  2. Creative Content and Prompts

    • What We Collect: Text prompts, uploaded images, generated content, and creative preferences you input into our AI systems.
    • Purpose: To process your requests, generate AI artwork, and provide personalized recommendations.

  3. Usage Details

    • What We Collect: Information about how you use Youart, including features accessed, generation history, usage frequency, and interaction patterns.
    • Purpose: To analyze user engagement, improve our AI services, and optimize platform performance.

  4. Device Information

    • What We Collect: Data regarding the devices you use to access Youart, such as device type, operating system, browser type, and IP address.
    • Purpose: To optimize our services for different devices, ensure compatibility, and provide technical support.

  5. Cookies and Tracking Technologies

    • What We Collect: Small data files placed on your device that help us track user preferences, session information, and improve user experience.
    • Purpose: To enhance the functionality of our services, remember your preferences, and personalize your creative experience.

  6. Payment and Billing Information

    • What We Collect: Information regarding your payment methods, billing address, transaction history, and subscription details.
    • Purpose: To facilitate billing and payment processing for our AI creative services and manage your subscription.

  7. Connected Social Account Data

    • What We Collect: When you choose to connect a social account, we receive the account or channel identifier, display name, profile image, permissions you granted, access and refresh tokens, token expiration, and the Pages, channels, professional accounts, organizations, or profiles you select. We also process content and media you ask us to publish, publishing status, platform post identifiers and links, and available performance metrics for your own content.
    • Platforms: This may include YouTube, Facebook, Instagram, X, LinkedIn, and TikTok. During a migration period, an integration provider may process the same data on our behalf; our current subprocessors are disclosed through this policy and related service notices.
    • Purpose: We use this data only to connect the destinations you select, publish or schedule content at your direction, show delivery status and available analytics, prevent duplicate delivery, support your requests, protect the service, and comply with platform rules. We do not use social platform data to train generative AI models or to build advertising profiles.
    • Your Choice: Connecting a social account is optional. The authorization screen identifies the permissions requested. Where a separate permission is needed for analytics, we request it only when you enable that feature. You can disconnect an account at any time.

Desktop Features and Local Files

Signing in to YouArt Desktop connects the application to your YouArt account; it does not by itself grant Agent access to local files.

  • Folder access: You can select folders in the desktop application's Local file access settings. This permits the Agent to list and search those folders and their subfolders and read supported files for your requests. File names, paths, and requested text may be sent to YouArt and the AI service providers used to process your requests. Avoid selecting folders containing credentials or unrelated sensitive information.
  • Image imports: When you ask to import a local image, the image is uploaded to your YouArt library and added to the requested Canvas. These uploads are handled as creative content under this policy.
  • Saving files: Saving a Canvas asset uses a separate system Save dialog to choose a new destination. Folder-read access does not grant permission to overwrite or delete existing local files.
  • Your controls: Folder permissions apply to the same YouArt account across chats on that device until you remove them. Removing permission stops subsequent access and cancels pending file operations, but it does not recall content already sent or delete uploaded assets or conversation history. Those remain subject to the retention and deletion provisions of this policy.

AI-Generated Content

  • Content Ownership: You retain ownership of the prompts you provide and the AI-generated content created through our platform.
  • Content Usage: We may use anonymized and aggregated data from your creative activities to improve the quality of our platform and services.
  • Content Moderation: We implement content filtering to ensure generated content complies with our community guidelines and applicable laws.

Data Storage and Security

We take the security of your personal information and creative content seriously. The data we collect is stored securely on our servers using industry-standard security measures including:

  • Encryption of data in transit and at rest
  • Access controls and authentication systems
  • Regular security audits and monitoring
  • Secure cloud infrastructure providers

However, please be aware that no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Information Sharing and Disclosure

We do not sell, trade, or otherwise transfer your personal information or creative content to outside parties, except in the following circumstances:

  • AI Service Providers: We may share data with trusted third-party AI service providers (such as OpenAI, Midjourney, or other AI model providers) necessary to process your creative requests.
  • Legal Compliance: To comply with legal obligations or respond to lawful requests from public authorities.
  • Safety Protection: To protect our rights, property, or safety, or that of our users or others.
  • Service Partners: To provide services through trusted third-party partners who assist us in operating our platform, subject to strict confidentiality agreements.

Data Retention

We retain your personal information and creative content for as long as necessary to provide our services and comply with legal obligations. You may request deletion of your account and associated data at any time, subject to legal retention requirements.

For connected social accounts, authorization credentials are retained only while the connection is active or while needed to complete a pending action you requested. When you disconnect an account, we disable the connection and revoke the authorization where the platform supports revocation. We then delete access and refresh tokens, selected account profile data, and restricted platform metrics in accordance with the applicable platform requirements and our deletion process. We may retain minimal security, consent, delivery, and deletion records where required to prevent abuse, resolve disputes, demonstrate compliance, or meet legal obligations. Published content can remain on the social platform after disconnection; you can delete it on that platform or through YouArt where the platform permits us to do so.
